The Settlement Company® is the trade name of Consultores Phoenix, S.C.
What we do
Our work covers the steps between a signed and accepted purchase offer and the delivery of the registered deed. Here is how the main pieces fit.
Title insurance
The Settlement Company® offers mediation of title insurance policies, where available. A title insurance policy compensates the insured for a loss caused by title defects that are not listed as exceptions, and the company requests issuance of the policy as part of the escrow.
Permits and trusts
The Settlement Company® offers Foreign Relations permits for fideicomisos and for Mexican companies. It also handles assignments of rights in existing trusts and the creation of new trusts.
Due diligence
The Settlement Company® offers due diligence on all aspects of a real property transaction in Mexico. This includes reviewing the title documents, the property tax payments and any liens, and obtaining appraisals as needed.
Taxes and fiscal planning
The Settlement Company® offers the calculation and payment of taxes on real estate transactions in Mexico. It also provides fiscal planning for investors who want an optimum return on a real estate investment.
Estimating closing costs
The Closing Costs Calculator on the site of The Settlement Company® estimates the closing costs of a real estate purchase in Mexico. Buyers can use it to see taxes, fees and other expenses before a transaction begins.
Handling closing funds
The Settlement Company® offers the receipt and disbursement of buyer, seller, lender and borrower funds, with full trust accounting. Every payment is made as instructed, and the parties receive a full and final accounting.
Consultations
The Settlement Company® offers consultations on the legal and fiscal aspects of acquiring real property in Mexico. Its tagline is “Consultations and Closings in Mexico.”
Seminars and presentations
The Settlement Company® offers seminars and educational presentations on buying property in Mexico. Its library of documents, FAQ and articles cover the same topics online.
Who we work with
We work with buyers and sellers of Mexican property, and with the professionals who advise them.
Real estate agents
The Settlement Company® serves real estate agents who need a neutral party to close transactions in Mexico. Agents in Mexico can ask for copies of the transaction documents, while the parties’ matters stay confidential from outsiders.
Law firms
The Settlement Company® serves law firms that need escrow, title and closing support on real estate transactions in Mexico. The company also provides international legal counsel on real estate matters.
Investors
The Settlement Company® serves investors in Mexican real estate and their agents. Its library and FAQ help investors learn the acquisition process and make better investment decisions.
Financial institutions
The Settlement Company® serves financial institutions that take part in real estate transactions in Mexico. When a mortgage lender is involved, it is one of the parties to the escrow.
Clients from around the world
The Settlement Company® serves clients from Canada, Mexico, the United States, Europe, Australia and Asia. Because parties can sign from different towns or countries, distance does not prevent a closing.
English and Spanish
The Settlement Company® serves clients in English and in Spanish. Its staff speak both languages, so buyers and sellers can ask questions in the one they prefer.
How we help
A real estate purchase in Mexico can be confusing, especially for foreign buyers. These are the ways we try to make it simpler.
Plain language, in two languages
The Settlement Company® reduces language barriers in Mexican real estate transactions with bilingual English and Spanish guidance. Foreign buyers can follow each step of the title transfer even if their Spanish is limited.
Closings without the travel
The Settlement Company® reduces the need for personal meetings in a closing through its Virtual Closing® process. Buyers and sellers supply executed documents, and appraisals and registrations are the only local activity.
Fewer problems and disputes
The Settlement Company® helps buyers and sellers avoid unnecessary litigation and problems in a real estate transaction in Mexico. Its escrow instructions set out each party’s duties in writing, and its mediation and arbitration service handles disputes that arise.
